Terms of Service

Welcome to WhisperWall (also known as My Own Campus). These Terms of Service (the "Terms") are a binding agreement between you and WhisperWall ("we," "us," or "our"). WhisperWall is operated as an online service available at myowncampus.vercel.app and future official domains we announce.By accessing or using our website, apps, and related services (collectively, the "Services"), you agree to these Terms, our Privacy Policy, our Refund Policy, and our Community Guidelines. If you do not agree, do not use the Services.

PLEASE READ CAREFULLY. THESE TERMS INCLUDE LIMITATIONS OF LIABILITY, A CLASS ACTION WAIVER, AND AN AGREEMENT TO RESOLVE MOST DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT. IF YOU DO NOT AGREE, YOU MAY NOT USE THE SERVICES.

1. Eligibility and accounts

The Services are intended only for individuals who are eighteen (18) years of age or older. By using the Services, you represent that you are at least 18. We do not knowingly permit use by anyone under 18. If we learn that a user is under 18, we may suspend or terminate the account and delete associated data.

You may sign in with supported providers or continue anonymously where available. You agree to provide accurate information and to keep your access credentials secure. You are responsible for all activity under your account. Notify us promptly at whisperwall.help@gmail.com if you believe your account was accessed without permission.

You may not impersonate another person, use a name you do not have the right to use, transfer your account without our written consent, or share login access with others.

2. The Services

WhisperWall is an online platform for anonymous posts, private chat, optional random matching on Connect (text, voice, or video), digital plans, and related features. Features may change, be added, or be removed at any time.

You will use the Services only for lawful personal use and in compliance with these Terms and applicable law. If your use is prohibited where you live, you are not authorized to use the Services.

3. User content and licenses

Anything you post, upload, send, store, or otherwise make available through the Services is your "User Content." You retain ownership of your User Content, but you are solely responsible for it.

You represent that you have all rights needed to submit your User Content and that it does not violate law or anyone else's rights. To operate the Services, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt for technical purposes, and distribute your User Content only as needed to provide, secure, and improve the Services. This license ends when your content is deleted from our systems, except where retention is required by law or reasonable backup practices.

We may remove or restrict User Content, or suspend accounts, that violate these Terms, our Community Guidelines, or applicable law.

4. Prohibited conduct

You agree not to use the Services to:

  • Harass, threaten, bully, stalk, dox, or discriminate against others.
  • Share sexually explicit content, pornography, or content involving minors.
  • Promote violence, self-harm, illegal drugs, weapons, or other unlawful activity.
  • Commit fraud, spam, phishing, scams, or deceptive money-making schemes.
  • Impersonate any person or entity, including staff or other users.
  • Record, screenshot, or redistribute another person's live conversation without their clear consent, except where required by law.
  • Solicit personal information from anyone under 18.
  • Upload malware or attempt to disrupt, scrape, or reverse engineer the Services.
  • Use the Services for commercial solicitation not expressly permitted by us.
  • Infringe intellectual property, privacy, or other rights of third parties.

We may investigate violations and cooperate with law enforcement where appropriate. Serious violations may result in permanent removal.

5. Connect, calls, and matching

Connect and related features may pair you with strangers. We do not guarantee the identity, age, intentions, or behavior of other users. You interact with others at your own risk.

Voice and video sessions may be subject to safety review, including automated and human review where permitted by law and described in our Privacy Policy. Do not share financial details, passwords, or sensitive personal information with strangers.

You may end a session at any time. Use block and report tools when someone violates our rules.

6. Purchases, plans, and virtual items

Optional paid plans and digital perks may be offered through our checkout flow when available. Paid subscriptions may not be open at all times. When offered, prices and features are shown before you pay. Amounts may be displayed in US dollars or local currency at checkout depending on your location. Refunds and cancellations are described in our Refund Policy. Unless required by law, purchases are final once delivered or activated.

Paid plan time is linked to your account. Compatible plans may extend existing paid time. If payment succeeds but a plan does not appear, use in-app restore options or contact Support with the approximate purchase time.

We may change prices, features, or availability, including pausing or discontinuing paid offerings, with reasonable notice where required. Continued use after a change constitutes acceptance where permitted by law.

For users in the EU, EEA, UK, or Switzerland: where applicable law grants a withdrawal period for digital services, you may lose that right if you request immediate access and acknowledge that performance begins before the withdrawal period ends. Withdrawal rights, if any, do not restart on automatic renewals unless required by law.

7. Account deletion

You may delete your account in Settings. Deletion is permanent and removes your profile, active plans, chats, Connect history, and related data from our active systems, subject to legal retention obligations. Remaining paid plan time is forfeited.

8. Third-party services

The Services may link to or integrate with third-party sign-in, payment, or content providers. Those services are governed by their own terms and policies. We are not responsible for third-party sites, products, or conduct.

9. Disclaimer of warranties

THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT OTHER USERS WILL BEHAVE LAWFULLY OR SAFELY.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHISPERWALL AND ITS OWNERS, OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICES OR INTERACTIONS WITH OTHER USERS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (USD $100) OR (B) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms limits liability that cannot be limited under applicable consumer protection law.

11. Indemnity

You agree to defend, indemnify, and hold harmless WhisperWall and its operators from claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

12. Release of claims between users

If you have a dispute with another user, you release WhisperWall from claims, demands, and damages of every kind arising out of or connected with that dispute. We are not obligated to intervene in disputes between users, but we may do so at our discretion.

13. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules, except where mandatory local consumer protection laws in your country require otherwise.

14. Dispute resolution and arbitration

Before filing a claim, you agree to contact us at whisperwall.help@gmail.com and attempt to resolve the dispute informally.

Except for qualifying small-claims matters or requests for injunctive relief to stop unauthorized use or intellectual property abuse, any dispute arising out of these Terms or the Services will be resolved by binding individual arbitration rather than in court, unless prohibited by law in your jurisdiction.

YOU AND WHISPERWALL AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

You may opt out of arbitration within thirty (30) days of first accepting these Terms by emailing whisperwall.help@gmail.com with your name, account email if any, and a clear opt-out statement.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page and update the "Last updated" date. Your continued use after changes become effective means you accept the revised Terms, except where applicable law requires a different process.
